These Terms and Conditions govern all photography services provided by Desert Photo Co., operated by Parallel Mirrors LLC ("we," "us," or "our"). By booking a shoot, you ("Client") agree to be bound by these terms. Please read them carefully before proceeding.
By booking a shoot, Client confirms they are the property owner or an authorized representative with the legal right to grant access to the property for photography purposes.
Client is solely responsible for ensuring all necessary permissions, HOA approvals, or landlord consents have been obtained prior to the shoot. Desert Photo Co. assumes no responsibility for unauthorized access claims arising from a booking.
Desert Photo Co. and its photographers carry general liability insurance. We exercise reasonable care while on-location. However, we are not responsible for pre-existing damage, wear, fragile items, or conditions present at the property prior to our arrival.
Any claims for damage allegedly caused during a shoot must be reported in writing to hello@desertphotoco.com within 24 hours of shoot completion. Claims reported after this window will not be considered.
Desert Photo Co. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from our services. Our total liability to Client shall not exceed the amount paid for the shoot in question.
Client agrees to indemnify and hold harmless Desert Photo Co., Parallel Mirrors LLC, and its photographers from any claims, damages, or expenses arising from misrepresentation of access authority or Client's own negligence.
Desert Photo Co. retains full copyright ownership of all images produced during a shoot. Upon receipt of full payment, Client receives a non-exclusive, non-transferable license to use the delivered images for property listing, marketing, and promotional purposes related to the photographed property.
Images may not be resold, sublicensed, or transferred to third parties without prior written consent from Desert Photo Co. Images may not be used in a manner that implies endorsement of unrelated products or services.
Client may use delivered images across platforms including Airbnb, VRBO, MLS, social media, personal websites, and print marketing without additional fees, for as long as they own or manage the property.
Desert Photo Co. reserves the right to use any delivered images in our portfolio, website, social media, and marketing materials to showcase our work.
If Client wishes to opt out of portfolio use, this must be requested in writing prior to the shoot date. Requests made after image delivery will not be honored.
Full payment is due at the time of booking. All payments are non-refundable.
Reschedules with 48+ hours notice are accepted at no charge. Client may reschedule once at no cost. A second reschedule may incur a $75 rescheduling fee.
Reschedules within 48 hours of the scheduled shoot time, cancellations, or no-shows forfeit full payment. A new booking and payment will be required.
Desert Photo Co. reserves the right to cancel or reschedule a shoot due to extreme weather, photographer illness, or circumstances beyond our control. In such cases, Client will be offered a full reschedule at no additional cost, or a full refund if rescheduling is not possible.
Client is responsible for providing accurate and working access information (lockbox codes, gate codes, key locations, etc.) prior to the shoot. This information must be included in the booking notes or communicated to hello@desertphotoco.com at least 24 hours before the scheduled shoot time.
If the photographer cannot access the property within 15 minutes of the scheduled start time due to missing or incorrect access information, the shoot will be considered a no-show and full payment will be forfeited.
Properties should be prepared and ready for photography at the scheduled shoot time. Time lost due to an unprepared property will reduce available shooting time without adjustment to the fee.
Desert Photo Co. aims to deliver all edited images within 48 hours of the shoot via a private online gallery link. Delivery times may vary during peak periods or due to circumstances beyond our control.
Delivered images are web-resolution files optimized for online use. Print-resolution files are not included in standard packages unless otherwise stated at the time of booking.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of San Bernardino County, California.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
